All Land Development Applications requiring Public Hearing must notify surrounding property owners. The Office of the Planning Commission will handle this notification.

UDC Section 19.41 Notice of Public Hearing: “The official notice of the time and place of any required public hearing with respect to Land Development Applications shall be the publication of such notice as required above. A supplemental notice of the time and place of any required public hearing shall be mailed via regular mail from the Office of the Planning Commission not less than fifteen (15) days in advance of the hearing to all owners of real property within one hundred fifty (150) feet of the boundaries of the land upon which a Land Development Application is requested. For the purpose of notice requirements to abutting property owners, the names and addresses of such owners shall be deemed to be those on the current Geographic Information System in the office of the East Baton Rouge Planning Commission. Failure of owners to receive supplemental notice of hearing shall in no way affect the validity of the action taken.”

A-1 Application for Rezoning and/or Horizon Plan Land Use Plan Amendment

The Planning Commission shall advertise the proposed rezoning or land use amendment request in suitable block ad form not less than two (2) columns wide, three (3) times, the first of which shall appear not less than ten (10) days prior to the Planning Commission meeting. (Section 19.4) The cost of advertising varies and will be borne by the applicant.

Each Large Scale Land Use Amendment (over 5 acres) the applicant shall publish a “display ad” at least ten (10) days prior to the date of the Planning Commission public hearing. This ad shall be no less than one-quarter page in the official journal of the City of Baton Rouge and Parish of East Baton Rouge. Such ad shall not be placed in that portion of the newspaper where legal notice and classified advertisements appear. The headline in such advertisement shall be in a type no smaller than 18 points. (Section 19.95)

A-2 Application for Preliminary Subdivision

The Planning Commission shall advertise the proposed preliminary subdivision one (1) time 10 days prior to the Planning Commission meeting. The cost of advertising varies and will be borne by the applicant.  

A-4 Application for Site Plan

The Planning Commission shall advertise the proposed site plan one (1) time 15 days prior to the Planning Commission meeting. (Section 4.101,B,1,C ) The cost of advertising varies and will be borne by the applicant. 

A-8 Application for Wireless Tower Site Plan

The Planning Commission shall advertise the proposed Wireless Tower Site Plan in suitable block ad form not less than two (2) columns wide, three (3) times, the first of which shall appear not less than ten (10) days prior to the Planning Commission meeting. (Section 14.43) The cost of advertising varies and will be borne by the applicant.

A-12-A Application for Planned Unit Development Concept Plan

The Planning Commission shall advertise the proposed Planned Unit Development in suitable block ad form not less than two (2) columns wide, three (3) times, the first of which shall appear not less than ten (10) days prior to the Planning Commission meeting. (Section 19.4) The cost of advertising varies and will be borne by the applicant.

A-12-B Application for Planned Unit Development Final Development Plan

The Planning Commission shall advertise the proposed Planned Unit Development in suitable block ad form not less than two (2) columns wide, three (3) times, the first of which shall appear not less than ten (10) days prior to the Planning Commission meeting. (Section 19.4) The cost of advertising varies and will be borne by the applicant.

A-12-C Application for Small Planned Unit Development

The Planning Commission shall advertise the proposed Small Planned Unit Development in suitable block ad form not less than two (2) columns wide, three (3) times, the first of which shall appear not less than ten (10) days prior to the Planning Commission meeting. (Section 19.4) The cost of advertising varies and will be borne by the applicant.

A-17 Application for Conditional Use Permit

The Planning Commission shall advertise the proposed Conditional Use Permit request in suitable block ad form not less than two (2) columns wide, three (3) times, the first of which shall appear not less than ten (10) days prior to the Planning Commission meeting. (Section 19.4) The cost of advertising varies and will be borne by the applicant.

A-19 Application for Demolition or Relocation of a Historic Building in the Downtown Development District

The Planning Commission shall advertise the proposed Demolition or Relocation request in suitable block ad form one (1) time which shall appear not less than ten (10) days prior to the Historic Preservation Committee meeting. (Section 3.5) The cost of advertising varies and will be borne by the applicant.

A-20 Application for Certificate of Appropriateness

The Planning Commission shall advertise the proposed Alteration, Addition, or New Construction request in suitable block ad form one (1) time which shall appear not less than ten (10) days prior to the Historic Preservation Committee meeting. (Section 3.5) The cost of advertising varies and will be borne by the applicant.

A-21 Application for Local Landmark/District Designation

The Planning Commission shall advertise the proposed Landmark or District request in suitable block ad form one (1) time which shall appear not less than ten (10) days prior to the Historic Preservation Committee meeting. (Section 3.5) The cost of advertising varies and will be borne by the applicant.

A-22-A Application for Traditional Neighborhood Development Concept Plan

The Planning Commission shall advertise the proposed Planned Unit Development in suitable block ad form not less than two (2) columns wide, three (3) times, the first of which shall appear not less than ten (10) days prior to the Planning Commission meeting. (Section 19.4) The cost of advertising varies and will be borne by the applicant.

A-22-B Application for Traditional Neighborhood Development Final Development Plan

The Planning Commission shall advertise the proposed Planned Unit Development in suitable block ad form not less than two (2) columns wide, three (3) times, the first of which shall appear not less than ten (10) days prior to the Planning Commission meeting. (Section 19.4) The cost of advertising varies and will be borne by the applicant.

Large Scale Land Use Amendment Sample

The following sample are to be use with the A-1 Application for Rezoning and/or Horizon Plan Land Use Plan Amendment, A-12-A Application for Planned Unit Development (Concept Plan), and A-12-C Application for Small Planned Unit Development, and A-22-A Application for Traditional Neighborhood Development (Concept Plan).

Horizon Plan Land Use Plan Amendment Large Scale, ¼ page ad (over 5 acres)

NOTICE OF CHANGE OF LAND USE

It is proposed to change the Horizon Plan “2010 Land Use Plan” from _______________ (land use category) to________________ (land use category) within the area shown on the map below. A public hearing on the proposal will be held by the Planning Commission on ______________ (date and time) and the Metropolitan Council on __________________(date and time) at _____________________(meeting place).

Such advertisement shall contain a geographic location map which clearly indicates the area covered by the proposal. The location map shall include major street names as a means of identification of the area.
